Terms and Conditions of Sale

These Terms and Conditions of Sale (hereinafter “Conditions”) govern the purchase contract concluded between Maurizia Bonvini (hereinafter “Seller”) and the customer (hereinafter “Buyer”) through the website www.mauriziabonvini.com (hereinafter “Website”).

Purchasing artworks through the Website implies that the Buyer has read, understood and fully accepted these Conditions. Please read them carefully before placing an order.

These Conditions are drafted in compliance with Italian Legislative Decree 206/2005 (Consumer Code), Italian Legislative Decree 21/2014 (implementing EU Directive 2011/83/EU on consumer rights) and EU Regulation 2016/679 (GDPR).

Maurizia Bonvini operates as a private individual non-trader and does not hold a VAT number. Sales are made on a non-continuous basis pursuant to Article 67 of the Italian Income Tax Consolidation Act (TUIR). No VAT invoice is issued; a payment receipt will be provided upon completion of the purchase.


2. Subject Matter

The Website offers for sale original artworks created by Maurizia Bonvini, including paintings on canvas and watercolours. Each artwork is a unique, one-of-a-kind piece, signed by the artist.

Images of artworks published on the Website are reproduced as faithfully as possible; however, colours and dimensions as perceived on screen may differ slightly from the original due to the characteristics of individual display devices. Such differences do not constitute a defect or non-conformity.


3. Prices

Artwork prices are listed in Euro (€) and are inclusive of all applicable taxes. Shipping costs are free of charge to any destination worldwide.

The Seller reserves the right to modify prices at any time. The price applicable to an order is the one shown on the Website at the time the Buyer confirms the order.

As the Seller operates as a private individual without a VAT number, prices shown do not include VAT and no tax invoice will be issued.


4. Order Process

To make a purchase, the Buyer must:

  1. Select the desired artwork and add it to the cart
  2. Proceed to checkout and enter the required details (name, surname, shipping and billing address, email, phone number)
  3. Select the available payment method
  4. Confirm the order by clicking “Place Order” (or equivalent)

The Buyer will receive an order confirmation email containing a summary of the purchase and, in the case of bank transfer payment, the bank account details for payment.

The sales contract is deemed concluded when the Seller sends the order confirmation by email. The Seller reserves the right to decline orders in the event of artwork unavailability or for any other reasonable reason, notifying the Buyer promptly.


5. Payment Methods

The Website currently accepts the following payment methods:

  • Bank transfer (wire transfer): IBAN details will be provided in the order confirmation email. The artwork will be dispatched after receipt and verification of the payment, which may take 2–5 business days.

Additional payment methods may become available in the future (e.g. PayPal, SumUp). Payments via third-party platforms are managed entirely by the respective providers, who act as independent data controllers. The Seller does not access or store the Buyer’s payment data.

In the event of non-payment within 7 business days of order confirmation, the Seller reserves the right to cancel the order and make the artwork available again.


6. Shipping and Delivery

Shipments are carried out via a courier selected by the Seller, chosen according to the destination and the characteristics of the artwork.

Shipping costs are completely free of charge to all destinations worldwide.

Indicative delivery times

  • Italy: 3–7 business days from receipt of payment
  • Europe: 5–14 business days from receipt of payment
  • Rest of the world: 10–30 business days from receipt of payment

Times indicated are purely indicative and may vary depending on the destination, season or exceptional circumstances (e.g. public holidays, weather conditions, customs delays). The Seller is not liable for delays attributable to the courier or customs authorities.

Packaging

Each artwork is carefully packaged to ensure protection during transit. The Seller uses packaging materials appropriate to the size and fragility of each individual artwork.

Delivery and inspection

Upon delivery, the Buyer is required to inspect the condition of the package before signing for receipt. In the event of visibly damaged packaging, the Buyer must:

  1. Accept the package with reservation, noting the damage on the courier’s delivery document
  2. Photograph the package and its contents
  3. Contact the Seller within 24 hours of delivery at maurizia_bonvini@hotmail.com

Failure to report damage within the stated timeframe may affect the right to reimbursement or replacement.

International shipments and customs

For shipments outside the European Union, customs duties, import taxes or other charges may apply under the legislation of the destination country. Such costs are the sole responsibility of the Buyer. The Seller is not liable for any delays caused by customs procedures.


7. Right of Withdrawal

Pursuant to Italian Legislative Decree 21/2014 (Articles 52 et seq. of the Consumer Code), a Buyer acting as a consumer (a natural person purchasing for non-professional purposes) has the right to withdraw from the contract within 14 days of receiving the artwork, without needing to provide any reason.

How to exercise the right of withdrawal

To exercise the right of withdrawal, the Buyer must send a written notice to the Seller within the 14-day period, by email to maurizia_bonvini@hotmail.com, stating:

  • Full name
  • Order number
  • Artwork purchased
  • Explicit declaration of intent to exercise the right of withdrawal

The Buyer must return the artwork within 14 days of notifying the withdrawal, in the same condition in which it was received, adequately packaged.

Return shipping costs

The cost of returning the artwork is borne by the Buyer. The Seller is not liable for damage or loss during return transit; the Buyer is advised to use a trackable shipping service with appropriate insurance.

Refund

The Seller will refund the purchase price within 14 days of receiving the returned artwork and verifying its condition, using the same payment method used by the Buyer.

Exceptions to the right of withdrawal

The right of withdrawal does not apply to artworks created on the Buyer’s specific commission (personalised or bespoke goods, pursuant to Article 59(c) of the Consumer Code). In such cases, the Seller will provide explicit notice before the contract is concluded.


8. Legal Guarantee of Conformity

The artworks sold are unique original pieces. In the event of defects not attributable to normal use or transit, the Buyer is entitled to the legal guarantee of conformity provided by Articles 128–135 of the Consumer Code, with the possibility of requesting repair, replacement (where possible given the unique nature of the works), price reduction or contract termination.

Defects must be reported within 2 months of discovery.


9. Liability

The Seller is not liable for:

  • Delivery delays attributable to the courier or customs authorities
  • Damage caused by inadequate packaging during return shipment by the Buyer
  • Perceptual colour differences between Website images and the original artwork due to display device characteristics
  • Customs duties and import taxes applicable in the destination country

10. Intellectual Property

The purchase of an artwork does not transfer the copyright in that work. Maurizia Bonvini retains sole ownership of all rights of reproduction, distribution, public communication and derivation of the artwork, pursuant to Italian Law 633/1941 (Copyright Act) and EU Regulation 2019/790.

The Buyer acquires exclusively the physical ownership of the original artwork, without any right of reproduction or commercial exploitation.


11. Governing Law and Jurisdiction

These Conditions are governed by Italian law. For any dispute relating to the interpretation, performance or termination of the contract, the competent court is that of the place of residence or domicile of the consumer Buyer, pursuant to Article 66-bis of the Consumer Code.

Buyers resident in the European Union may also use the ODR platform (Online Dispute Resolution) of the European Commission, accessible at ec.europa.eu/consumers/odr, for alternative dispute resolution.


12. Changes to the Conditions

The Seller reserves the right to modify these Conditions at any time. Changes will be published on the Website with an updated date. The Conditions applicable to an order are those in force at the time of its confirmation.
